TERMS OF USE AND SALE

Version: 2.1
Last update: October 13, 2026
Entry into force: October 13, 2026. For a User who accepted an earlier version, this version applies from their new acceptance in the Application, under the conditions of Article 12.2.

PREAMBLE AND ACCEPTANCE

These General Terms (hereinafter the "Contract") govern the use of the ScanHorizon application (hereinafter the "Application") published by SAS SCAN HORIZON (hereinafter the "Publisher").

How you accept this Contract. Before you can use the Application, you are asked to review this Contract and the Privacy Policy, and to accept them expressly. This acceptance is recorded by the Publisher, together with its date, time, and the version number of the documents accepted. You can consult these documents at any time from the Application and from scan-horizon.com.

When this Contract is updated. When the Publisher publishes a new version of the Contract or of the Privacy Policy, you are asked to accept it again when the Application is launched, under the conditions of Article 12.

If you refuse. If you do not accept all or part of this Contract, you may not use the Application and must uninstall it.

TITLE I: TERMS OF USE (TOU)

ARTICLE 1. ACCESS, AGE CONDITIONS AND EQUIPMENT

1.1. Digital Majority (Strict Prohibition -13 years)

In accordance with applicable regulations, use of the Application is strictly prohibited for children under 13 years old. Below this age, data collection is not authorized without a complex parental verification mechanism that the App does not implement. Any account created by a user under 13 will be deleted without notice.

1.2. Minors (13 to 17 years)

Minors aged 13 to 17 may use the Application provided the holder of parental authority has authorized it. It is that person's responsibility to review this Contract and the Privacy Policy, and to supervise the minor's use of the Application.

The Publisher does not verify this authorization and has no technical means to do so. It relies on the age bracket declared at registration.

What the holder of parental authority can obtain, at any time. By writing to contact@scan-horizon.com, or directly from the Application where the option is available:

  • removal of the minor's account from public leaderboards, from "Settings > Account > Hide from public leaderboards";
  • deletion of the minor's account and all associated data;
  • information about the processing of the minor's data.

Advertising and measurement. Pursuant to Article 45 of the French Data Protection Act, personalized advertising, usage analytics, error reporting, and marketing use of profile data remain disabled for Users aged 13 to 15 once their age has been verified, regardless of the answer given on any consent screen, including from the Application's settings. As an additional precaution, only non-personalized advertising is served to all Users aged 13 to 17.

Clan chat. The Application includes a free-text chat room, reserved for members of the same clan, in which a minor may exchange messages with other Users, including adults. Enhanced protections apply to Users aged 13 to 15 (Article 11.5.2). The holder of parental authority is invited to inform the minor of this and to remind them never to share in the chat any information that could identify them or allow them to be found outside the Application (name, address, school, phone number, photograph). They may at any time request deletion of the minor's account under the conditions above.

Purchases. It is the responsibility of the holder of the payment account (Apple or Google account) to configure the parental controls and, where applicable, the purchase authorization offered by the platform. If a purchase is made by a minor without the authorization of the payment account holder, the refund request should be addressed in the first instance to the platform (Apple or Google), which has dedicated procedures for this purpose. The Publisher will also review, on a case-by-case basis, any substantiated request sent to contact@scan-horizon.com by the holder of parental authority.

1.3. Equipment

The User is solely responsible for the technical compatibility of their device and for their own connection costs.

ARTICLE 2. CRITICAL WARNING: PHYSICAL SAFETY

2.1. User Responsibility: The User acknowledges using the Application in the real world. They agree to remain vigilant of their immediate surroundings (cars, obstacles, pedestrians) and never to use the Application while driving.

Reasonable use. ScanHorizon is a game, not an activity to be pursued without a break. The Publisher recommends taking regular breaks. It does not organize, reward, or promote any challenge based on continuous playing time or excessive use of the Application. Content published by a User on this theme, including content featuring ScanHorizon, remains personal content that does not bind the Publisher.

2.2. Publisher's Liability: The Publisher's liability can never be excluded or limited in the event of bodily injury or death resulting from a fault attributable to it, or in the event of gross or willful misconduct. Any contrary provision of this Contract is without effect on this point.

Subject to this reservation, the Publisher is not liable for damage, proceedings, or losses resulting from an accident, trespassing, carelessness, or inattention by a User who failed to follow the vigilance recommendations of Article 2.1, provided such damage does not result from the Publisher's own breach of its obligations.

2.3. Limitation of liability:

Consumer Users. Where the User acts for purposes outside their trade, business, craft, profession, or agricultural activity, the Publisher's liability is governed by ordinary law. No liability cap applies to them.

Professional Users. Where the User acts within their professional activity, and subject to Article 2.2, the Publisher's total liability, on any basis, may not exceed the total amount actually paid by that User for the Application over the twelve (12) months preceding the event giving rise to the claim.

2.4. Restricted areas (Airports / Tarmac): The Application does not encourage, request, or permit users to enter airport tarmacs, secured airport areas, or any controlled/restricted zone. Users are solely responsible for complying with applicable laws, security perimeters, airport rules, and authority instructions. The Publisher disclaims any liability for trespassing, fines, arrests, damages, or losses resulting from unauthorized access.

ARTICLE 3. AERONAUTICAL DISCLAIMER

THIS IS NOT A NAVIGATION INSTRUMENT. Information about aircraft, airlines, altitude, speed, routes, and flight status is provided for informational and entertainment purposes only. Data may be delayed, incomplete, unavailable, or inaccurate and must not be treated as exact, certified, or operationally reliable. It is strictly forbidden to use ScanHorizon for aircraft piloting or any aviation safety-related activity. The Publisher disclaims liability for decisions or actions taken on the basis of such information.

ARTICLE 4. INTELLECTUAL PROPERTY

The entire ScanHorizon application (Flutter source code, algorithms, design, "Cyberpunk" graphics) is protected by French and international copyright law. Any unauthorized reproduction is strictly prohibited and constitutes infringement.

Aircraft photos used in the Application and/or on the website include attribution to the photographer and, where applicable, to the source website. Despite our best efforts, attribution errors may occur. For any claim, correction request, takedown request, or credit update, please contact support@scan-horizon.com. We will respond as quickly as possible and we respect the work of every photographer.

Use of user feedback: Any feedback, suggestion, improvement idea, recommendation, correction, or proposal submitted by a User, tester, or any contributor through any channel may be freely used, implemented, adapted, and exploited by the Publisher, free of charge, without attribution obligation or time limitation, the User waiving any objection to such use or any claim to compensation in this respect. This authorization does not constitute an assignment of the User's intellectual property rights in any protected work they may have submitted on this occasion.

The prohibition on extraction extends to leaderboard data, public profiles and clan member lists, including where accessible without authentication. Any qualitatively or quantitatively substantial extraction or reuse of the contents of these databases is prohibited, as is any repeated and systematic extraction or reuse of insubstantial parts.

ARTICLE 5. SERVICE AVAILABILITY

The Publisher uses reasonable means to ensure the accessibility and proper operation of the Application, without guaranteeing uninterrupted availability. Interruptions may occur, in particular for maintenance, updates, technical incidents, or force majeure.

The Application depends on third-party services, APIs, networks, and platforms, including download platforms, infrastructure providers, payment, messaging, measurement, advertising, mapping, and aeronautical data services. The Publisher does not guarantee the continuous availability, accuracy, or performance of such third-party services.

This clause concerns the technical availability of the service. It has no effect on the statutory conformity guarantee set out in Article 5 bis, from which no derogation is possible.

ARTICLE 5 BIS. STATUTORY CONFORMITY GUARANTEE

Principle. The Publisher must supply digital content and a digital service that conform to the Contract and to the objective conformity criteria set out by law. It is liable for any lack of conformity existing at the time of supply and, for services supplied continuously, for any lack of conformity arising throughout the supply period.

Duration. For the Business Class subscription and any other digital service supplied continuously, the guarantee applies throughout the supply period. For digital content supplied as a one-off, it applies for two (2) years from supply.

What you can ask for. In case of a lack of conformity, you may require that the content or service be brought into conformity, free of charge and within a reasonable time. Failing this, or where bringing it into conformity is impossible, causes major inconvenience, or does not happen within a reasonable time, you may obtain a price reduction or termination of the contract, under the conditions set out by law.

You have nothing to prove. Any lack of conformity appearing during the guarantee period is presumed to have existed at the time of supply. You do not have to prove it.

Free of charge. Exercising the statutory conformity guarantee is free. It is independent of the right of withdrawal under Article 8 and of the platforms' own commercial refund policies.

How to exercise it. Write to contact@scan-horizon.com describing the defect found. The Publisher will acknowledge receipt and inform you of the outcome.

No clause of this Contract may exclude or limit this guarantee.

TITLE II: TERMS OF SALE (TOS)

ARTICLE 6. PAID PRODUCTS AND SERVICES

6.1. Nature of purchases. All purchases offered in the Application are in-app purchases, made and billed exclusively by the download platform (Apple App Store or Google Play). The features, price, currency, and conditions applicable to each offer are those displayed on the platform's product page at the time of purchase, which prevail.

6.2. "Business Class" subscription. An automatically renewable subscription, for a one-month term unless another duration is displayed at the time of subscription. It gives access, for its validity period, to the benefits described in the Application, in particular: unlimited scans and no advertising; an extended default scan range; daily boosters (doubled range, vision through clouds); a second chance on the lucky wheel; activation of rarity counters; a weekly allocation of Rarity Lenses.

The exact, up-to-date list of benefits is presented in the Application before any subscription. A free trial period may be offered, under the conditions of Article 6 bis.

6.3. Consumables. One-off, non-renewable purchases credited to the User's account: Rarity Lens packs (of 1, 5, 10, or 25): each Rarity Lens is consumed upon use in the Application; Streak Saver: preserves an interrupted streak of consecutive scans. It may be purchased in advance and kept in reserve until used.

Consumables do not expire as long as the account is active. They are tied to the ScanHorizon account, not the platform account: they are not transferable, exchangeable, or refundable once consumed, and are lost if the account is deleted, under the conditions of Article 10.

6.4. "Gift Premium" offer. A one-off, non-renewable purchase intended to be given to a third party. Governed by Article 6 ter.

6.5. Modification of subscription benefits. The Publisher may change the benefits associated with the Business Class subscription, their nature, quantity, or access conditions, for a valid reason relating in particular to technical, security, game-balancing, or service-evolution grounds. This may be done at no extra cost to the User.

Minor changes, or changes favorable to the User, may take effect without notice.

Where a change has a more-than-minor adverse effect on access to, or use of, the benefits, the Publisher will inform the User on a durable medium, at least thirty (30) days before it takes effect, specifying the nature of the change, its effective date, and the User's rights. The User may then cancel their subscription free of charge within thirty (30) days of receiving that information or, if later, of the change's effective date.

ARTICLE 6 BIS. FREE TRIAL

6 bis.1. Principle and eligibility. The Publisher may offer a free trial period for the Business Class subscription. This period is an introductory offer implemented by the download platform (Apple App Store or Google Play). Eligibility for the free trial is determined by the platform and tied to the User's platform account. It is offered only once per platform account: a User who has already benefited from a trial period for this subscription, or for a subscription in the same group, is no longer eligible and will be charged immediately upon subscribing. The Application indicates, before any subscription, whether the User is eligible.

6 bis.2. Duration and displayed conditions. The trial duration, the price applicable at its end, the currency, and the billing frequency are those displayed in the Application and on the platform's product page at the time of subscription. These prevail. They may vary depending on the User's country and the platform's applicable pricing zone.

6 bis.3. Payment method. Subscribing to a free trial requires a valid payment method to be registered with the platform beforehand. No amount is charged during the trial period.

6 bis.4. Automatic conversion into a paid subscription. At the end of the trial period, unless cancelled beforehand by the User, the trial automatically converts into a paid, automatically renewable subscription. The first charge occurs on the trial end date, at the price displayed at the time of subscription. The subscription then automatically renews for successive periods of the same duration, until cancelled.

6 bis.5. Cancelling before the trial ends. The User may cancel at any time during the trial period, free of charge and without giving a reason. For cancellation to prevent the charge, it must occur at the latest twenty-four (24) hours before the trial end date, this deadline being imposed by the platforms. A cancellation made within the last twenty-four hours may not prevent the first charge.

Cancellation is done, at the User's choice:

  • from the Application, via the subscription management section accessible from the Control Tower and from the Application's settings, available at all times and free of charge;
  • or from the settings of the User's Apple or Google Play account.

Cancellation does not result in immediate loss of access: the User keeps the benefits until the end of the trial period.

6 bis.6. Confirmation sent to the User. When the trial period starts, the Publisher sends the User, at the email address associated with their account, a confirmation recalling: the nature and duration of the trial, the trial end date and the date of the first charge, the price and frequency of the subscription that will follow, the automatically renewable nature of that subscription, and the terms and deadline for cancelling. This confirmation constitutes the contract confirmation on a durable medium.

In addition, the Publisher sends the User, at that same email address, a reminder no later than two (2) days before the trial end date, indicating the date of the first charge, its amount, and including a direct link to the subscription cancellation page. Failure to receive this reminder, in particular due to an incorrect, unavailable, or filtered email address, has no effect on the conversion of the trial into a paid subscription.

6 bis.7. Account deletion. Deleting the ScanHorizon account does not cancel the trial period or the subscription that follows it, which are billed by the platform. The User must cancel separately, under the conditions of Article 6 bis.5.

6 bis.8. Right of withdrawal. The conditions for exercising the right of withdrawal applicable to subscribing to a free trial are set out in Article 8.

6 bis.9. Modification or withdrawal of the offer. The Publisher may modify, suspend, or withdraw the free trial offer for the future. Such a change has no effect on trial periods already under way, which continue under the conditions displayed when they were subscribed to.

ARTICLE 6 TER. "GIFT PREMIUM" OFFER AND GIFT CODES

6 ter.1. Purpose. The Publisher may offer a product allowing a User (the "Buyer") to give a third party (the "Recipient") access to the Business Class subscription for a fixed, non-renewable term of three (3), six (6), or twelve (12) months depending on the offer chosen. Only a User with a registered account and active Business Class access at the time of purchase, whatever its origin (subscription, trial period, gift code, or referral), may purchase this offer; this condition is checked before payment and again when the purchase is validated.

6 ter.2. Status of the parties. The sale contract is concluded between the Buyer and the download platform. The Buyer alone holds the rights attached to this purchase, including the right of withdrawal under Article 8. The Recipient acquires no right against the Publisher until the code is actually redeemed. If the Buyer exercises their right of withdrawal, the access opened to the Recipient by that code ends on the date of the refund.

6 ter.3. Delivery of the code. Upon purchase, a code is given to the Buyer, who is responsible for passing it on to the Recipient by whatever means they choose. The Publisher does not deliver the code to the Recipient and is not liable for its loss, disclosure to a third party, or use by anyone other than the intended Recipient.

6 ter.4. Code validity period. The code must be redeemed within ninety (90) days of its issuance. This period is displayed to the Buyer at the time of purchase and recalled when the code is delivered. After this period, the code can no longer be redeemed.

To avoid any loss: an unredeemed, expired code may be reissued once, free of charge, upon simple request from the Buyer to contact@scan-horizon.com, within twelve (12) months of purchase. The reissued code is then valid for a further ninety (90) days.

6 ter.5. Effect of redemption. Redeeming the code gives the Recipient, for the acquired duration, access to the benefits of the Business Class subscription. This access does not renew and gives rise to no charge: it ends automatically at its term.

6 ter.6. No monetary value. Codes may not be sold for payment, exchanged for money, or refunded once redeemed.

6 ter.7. Payment without a code being issued. If, after a payment actually charged by the platform, the code is not generated and the situation persists after a new attempt from the Application, the Buyer may obtain, at their choice, issuance of the code by the Publisher or a full refund of the purchase, by writing to contact@scan-horizon.com, or to the support address offered by the Application, stating the purchase date and, if possible, the transaction identifier shown on the platform's receipt. Where the refund is technically handled by the platform, the Publisher takes the necessary steps with it and informs the Buyer. This option is in addition to the platform's refund policies.

6 ter.8. Benefit attached to the twelve-month offer. Purchasing the twelve (12) month offer unlocks, for the Buyer, an exclusive avatar usable in the Application. This item is purely cosmetic: it has no market value, gives no gameplay advantage, is neither transferable nor exchangeable, and can neither be obtained nor refunded separately. It may be withdrawn if the purchase is refunded.

ARTICLE 7. PRICE AND PAYMENT TERMS

7.1. Displayed price. Prices are those displayed in the Application and on the platform's product page at the time of purchase. They are expressed inclusive of all taxes, in the currency applicable to the User's country as determined by the platform. The price displayed when the purchase is confirmed is the one that applies.

7.2. Payment. The transaction is carried out exclusively by the platform (Apple or Google). The Publisher does not collect, process, or store any banking data.

7.3. Price changes for an ongoing subscription. The price of an ongoing subscription may be changed for the future. In that case: the change has no effect on subscription periods already paid for; the User is informed in advance, by the platform and, where applicable, by the Publisher, before the effective date; the new price applies only from the next billing period; the User may cancel their subscription free of charge before that date, under the conditions of Article 9, if they do not accept the new price.

Where the platform's rules require the User's express consent to a price increase, the subscription is not renewed absent that consent.

7.4. Relationship with the platform's terms. The platform's terms on billing, charges, taxes, currency, commercial refunds, and cancellation apply to the transaction. In case of conflict with these Terms on these specific points only, the platform's terms prevail. This precedence has no effect on the rights the consumer User holds under the law, in particular under Articles 5 bis and 8 hereof.

ARTICLE 8. RIGHT OF WITHDRAWAL

8.1. Principle. A consumer User has a period of fourteen (14) days to exercise their right of withdrawal from a purchase made in the Application, without having to justify their decision. This period runs from the day the contract is concluded, in accordance with Article L.221-18 of the French Consumer Code.

8.2. Interaction with the free trial. Where the subscription includes a free trial period, the withdrawal period runs from the subscription date, not from the first charge. It may therefore expire after the first charge has occurred.

8.3. How to exercise it. The User informs the Publisher of their decision by any unambiguous statement sent to contact@scan-horizon.com. They may use the standard withdrawal form appended to these Terms, though its use is not mandatory.

8.4. Effects. The Publisher will refund the User the amounts actually paid under the withdrawn contract, no later than fourteen (14) days from receipt of the withdrawal decision, using the same payment method as for the original transaction, unless the User expressly agrees to a different method, at no cost to them. Where the refund is technically handled by the download platform, the Publisher will take the necessary steps with it and inform the User.

8.5. Legal exception. In accordance with Article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun after the User has expressly requested such early performance and expressly acknowledged that they would lose their right of withdrawal. The Publisher does not collect this waiver: the right of withdrawal under this article therefore remains available to the User under the conditions above.

8.6. Platforms' commercial refunds. Independently of the right of withdrawal, Apple and Google apply their own refund policies. The User may contact them directly. These policies have no effect on the rights the User holds under this article.

ARTICLE 9. SUBSCRIPTION TERM, RENEWAL, AND CANCELLATION

9.1. Term and automatic renewal. The Business Class subscription is taken out for the term displayed at the time of subscription, one month unless otherwise stated. It automatically renews, for successive periods of the same duration, until cancelled. Each renewal is charged by the platform, at the price then in effect.

9.2. How to cancel. The User may cancel at any time, free of charge and without giving a reason, either: from the Application, via the subscription management area accessible from the Control Tower and from settings. This area is available at all times, free of charge, and gives direct access to cancellation; or from the settings of their Apple or Google Play account.

9.3. Deadline to observe. For a cancellation to prevent the next charge, it must occur at the latest twenty-four (24) hours before the renewal date, this deadline being imposed by the platforms. A cancellation made within the last twenty-four hours may not prevent the next period's charge.

9.4. Effects. Cancellation takes effect at the end of the current subscription period. The User keeps access to the benefits until then. Unless mandatory law or the platform's policy states otherwise, no pro-rata refund is due for a period already begun.

9.5. Account deletion. Deleting the ScanHorizon account does not cancel the subscription, which is billed by the platform. The User must cancel separately, under the conditions of Article 9.2.

9.6. Payment failure. In case of a failed charge, refused payment, or suspension by the platform, subscription benefits may be suspended until the situation is regularized.

9.7. Restoring purchases. Restoration is available through the mechanisms provided by Apple and Google, subject to using the same platform account and the applicable technical and commercial rules.

9.8. Discontinuation of the ScanHorizon service. The Publisher may, at its discretion, decide to permanently discontinue the Application and the ScanHorizon service. In that case: Users with an active subscription are notified at least thirty (30) days before the effective discontinuation date, by an in-app notification and by email; from that notice onward, the subscription is no longer renewed and no further charge is made past the discontinuation date; where a subscription period or an offer under Article 6 ter has been paid in advance and the effective discontinuation date falls before its end, the Publisher refunds the portion of the price corresponding to the undelivered fraction of the period, calculated on a pro-rata basis; other than this pro-rata refund, the discontinuation gives rise, on that ground, to no indemnity or other form of compensation payable by the Publisher.

Digital goods already supplied or consumed before the discontinuation date, in particular used consumables and already-redeemed gift codes, give rise to no refund under this article.

This clause has no effect on the right of withdrawal under Article 8 or on the statutory conformity guarantee under Article 5 bis, for rights that remain accrued and not time-barred as of the discontinuation date.

ARTICLE 10. ACCOUNT DELETION

10.1. User's right. The User may request deletion of their account at any time, from the Application, from the form available on scan-horizon.com, or by writing to contact@scan-horizon.com.

10.2. Process. Deletion takes place in two stages, described in Article 9 of the Privacy Policy: immediate deactivation, then permanent deletion after a thirty (30) day period during which the User can recover their account by logging back in.

10.3. Consequences, disclosed to the User before confirmation. Before the User confirms their request, the Application shows a clear summary of the consequences of deletion: loss of scan history, collection, and progress; loss of acquired, unused consumables, in particular Rarity Lenses and reserved Streak Savers; removal from leaderboards and deletion of social data; the fact that an ongoing subscription is not cancelled by deleting the account and must be cancelled separately, failing which it will continue to be billed.

10.4. Ongoing subscription. It is strongly recommended to cancel the subscription, under Article 9.2, before requesting account deletion.

10.5. Specific requests. A User who believes they have suffered harm as a result of their account being deleted, in particular an accidental deletion shortly after a purchase, may send a substantiated request to contact@scan-horizon.com. The Publisher reviews such requests case by case and may re-credit or refund where circumstances justify it. This clause has no effect on the statutory conformity guarantee under Article 5 bis or on the right of withdrawal under Article 8.

ARTICLE 10 BIS. REFERRAL PROGRAM

The Publisher may offer a referral program allowing a User ("Referrer") to invite a third party ("Referee") to create an account and use the Application.

Rewards, attribution thresholds, validation delays, caps, exclusions, eligibility criteria, and benefit withdrawal rules are defined in the Application or in any official Publisher communication. These elements may be modified, suspended, or discontinued for the future, at any time. Such a change has no effect on benefits already earned and validated as of its effective date, subject to the fraud or abuse cases referred to in the last paragraph of this article.

Referral benefits have no cash value and are not transferable or redeemable for money unless expressly stated otherwise. In case of abuse, fraud, multiple-account creation, self-referral, technical circumvention, or breach of these Terms, the Publisher may cancel rewards, suspend program access, or close related accounts, without prejudice to any other available remedy.

ARTICLE 11. SOCIAL AND MULTIPLAYER FEATURES

11.1. Purpose

The Application offers social features: leaderboards, airport-based clans, a clan feed comprising structured messages and a free-text chat room reserved for clan members (the "clan chat"), team challenges, friend lists, invitations and profiles viewable by other players. Their use is optional and implies acceptance of this article.

The User is informed that these features make some of their data visible to other users, under the conditions described in Article 2.10 of the Privacy Policy, and that leaderboards are accessible to any user of the Application.

11.2. Clan chat and structured messages

The clan feed is visible only to clan members, fifty at most. It brings together predefined structured messages (scan request, showcasing a card from your hangar), reactions chosen from a closed emoji list, automatic events (members joining and leaving) and the clan chat, a free-text chat room.

A chat message contains at most five hundred characters. It may contain neither images nor files, and website addresses are displayed as plain, non-clickable text. Only the clan's last hundred messages can be viewed; older ones are deleted under the conditions of Article 7 of the Privacy Policy.

The User may at any time delete a message they wrote. For the other members, the message is then replaced by the notice "message deleted".

The Application offers no private messaging between Users. Friend requests and clan invitations contain no message field.

The Publisher may temporarily suspend the chat, for all or some clans or versions of the Application, in particular in the event of a technical incident, a risk to Users' safety, or widespread abuse. Structured messages then remain available.

The first time they open their clan feed, the User must read and accept a reminder of the chat rules in order to access it. These rules remain available at any time from the chat header.

Usernames and chat messages are subject to the rules of conduct in Article 11.3.

11.3. Rules of conduct and choice of username

The User undertakes not to use the social features, including the clan chat, to:

  • choose a username that is unlawful, insulting, hateful, discriminatory, sexual in nature, glorifying terrorism or crimes against humanity, or infringing the rights of a third party (in particular a name, a trademark, or another person's identity);
  • impersonate a third party, a member of the ScanHorizon team, or a public or airport authority;
  • post a message that is hateful, discriminatory, threatening, violent or sexual, or that glorifies terrorism, crimes against humanity or any other offence;
  • insult, humiliate, harass or disturb another user, including through repeated messages or by inciting other members to do so, in particular where a minor is concerned;
  • ask another user, in particular a minor, for personal information (name, address, school, phone number, photographs), for contact outside the Application, or for a meeting;
  • disclose a third party's personal data without their consent;
  • post advertising or phishing messages, repeated or automated messages, or flood the feed (repetitions, excessive capital letters);
  • infringe a third party's intellectual property rights;
  • create multiple accounts, self-refer, use third-party software, a modified client, automation, or any technical circumvention in order to distort a leaderboard, a challenge, a scan counter or a reward mechanism;
  • extract, collect or reuse other users' data by automated means, including data appearing on the leaderboards.

11.4. Reporting content or behaviour

In accordance with Article 16 of Regulation (EU) 2022/2065 (Digital Services Act), any person may report content they consider illegal or contrary to Article 11.3, in particular a username or a clan chat message.

From the Application. Each chat message can be reported from its menu (long press on the message). The User chooses a reason (insult, harassment, spam, inappropriate content, or other) and may add an optional comment of up to two hundred and forty characters. The message concerned, the surrounding messages, the reason, that comment and the identity of the reporting party are then automatically sent to the Publisher. The reporting party's username and comment are visible to the person who reviews the report (player moderator or the Publisher's team); they are not disclosed to the author of the reported message.

By email. Any other report, in particular one concerning a username or one made by a person without an account, is sent to contact@scan-horizon.com. To enable effective handling, the report should include: a sufficiently substantiated explanation of the reasons why the content is considered illegal, its precise location (for example the username concerned and the screen on which it appears), the name and email address of the reporting party (except where the content concerns offences referred to in Articles 3 to 7 of Directive 2011/93/EU), and a statement of good faith as to the accuracy of the information provided.

Provisional hiding. A chat message reported by three different members is automatically hidden pending review. This automated, provisional measure is followed by a human review, after which the message is either restored or subject to a reasoned measure under the conditions of Article 11.5.

Handling. We acknowledge receipt of the report without delay and inform its author of the decision taken and of the available redress options. Reports made by a User aged 13 to 15 are reviewed as a priority.

11.5. Moderation: policies, procedures, measures and tools

This article is published pursuant to Article 14 of Regulation (EU) 2022/2065. It applies to usernames, to structured clan feed messages and to clan chat messages.

11.5.1. Four levels. Moderation relies on automated filtering (11.5.2), on reporting and blocking by members (Articles 11.4 and 11.9), on volunteer player moderators (11.5.3) and on the Publisher's team, which alone decides on bans, handles complaints and supervises moderators.

11.5.2. Automated tools. Usernames are subject, upon creation, to automated filtering against a list of prohibited terms. This filtering is applied without human intervention and may result in the immediate rejection of a username.

Chat messages are filtered by the server before they are posted, after a normalization designed to defeat simple workarounds (accents, digits substituted for letters, repeated letters). A message containing a term from the most serious list (hate, threats, serious insults) is rejected, with an explanation shown to the User. A term from the list of common profanities is replaced with asterisks before posting.

Automatic limits also apply: at most one message per second and twenty per minute; rejection of the same message sent three times in a row. A message of more than three words written more than 70% in capital letters is not rejected: it is posted in lower case.

Enhanced protections for Users aged 13 to 15. For them, the list of common profanities is treated like the most serious list: the message is rejected instead of being posted with asterisks. Their sending limits are reduced to one message every two seconds and ten per minute.

These tools do not use any artificial intelligence system. They act only on the message at the time it is sent, or through the provisional hiding described in Article 11.4, and do not by themselves impose any mute, ban or suspension. Separate automated measures, intended for service security and to fight scan automation, are described in Article 8 bis of the Privacy Policy; they do not concern content and are governed by a separate regime.

11.5.3. Volunteer player moderators. The Publisher may entrust volunteer Users aged at least eighteen with a chat moderator role, exercised only in clans other than their own. This role is granted and withdrawn at the Publisher's discretion, without notice.

This role is voluntary and gives rise to no consideration of any kind: no money, no currency or benefit usable in the Application, no premium access. A visible distinguishing sign (badge) may however be granted. No obligation is imposed on the moderator: no volume of reports, no hours, no deadline. They may stop at any time, without giving a reason, by no longer using the moderation tools or by informing the Publisher. Withdrawal of the role is the only consequence that may be attached to its exercise.

Before accessing the moderation tools, the moderator accepts the Moderators' Charter: confidentiality, impartiality, no screenshots or sharing, no contact outside the Application with the players concerned.

The moderator may hide or delete a message, issue a warning, mute a User for up to seven days, and dismiss a report. Where the measure they consider necessary exceeds their powers (in particular a ban), they may propose it to the Publisher's team, which alone decides; such a proposal applies no measure. To handle a report, they see the reported message and the surrounding messages, with their authors' usernames and avatars, as well as the reporting party's username and any comment they added. To assess the situation, they may also view the moderation measures already taken against the reported player, as well as the messages that player posted over the last thirty days in clans other than the moderator's own; each viewing of these messages is logged. They never see the email address or other account data. Each of their actions is logged and may be reversed by the Publisher's team, which reviews a sample of actions every week. This review concerns the soundness of decisions, not the moderators' activity. The Publisher remains responsible for all moderation measures, including those taken by a player moderator.

11.5.4. Human review. Any restriction decision other than the automatic rejection of a username or a message and the provisional hiding under Article 11.4 (suspension, account deletion, withdrawal of an already-assigned username, hiding or deletion of a message, warning, mute, chat ban, exclusion from a leaderboard or challenge) is taken after human review, by a player moderator or by the Publisher's team.

11.5.5. Measures that may be taken. Rejection or withdrawal of a username and a request to choose a new one; hiding or deletion of a message; warning, which restricts no feature but remains in the player's moderation history for twelve months and may be taken into account in the event of a repeat offence; mute, which prevents writing in the chat of any clan until it expires, including after changing clan; chat ban, decided by the Publisher's team alone; exclusion from a clan, a challenge or a leaderboard; cancellation of improperly obtained rewards; temporary suspension; termination of the account.

As a guide only, without binding the assessment of each situation:

  • spam or repeated messages: 1-hour mute, then 24 hours for a repeat offence;
  • isolated insult: warning or 24-hour mute, then 7 days;
  • harassment: 7-day mute, then chat ban;
  • hate, threats, sexual content: chat ban from the first occurrence.

11.5.6. Proportionality. In accordance with Article 14.4 of the same Regulation, the Publisher applies these restrictions in a diligent, objective and proportionate manner, with due regard to the rights and legitimate interests of all parties involved, including the User's freedom of expression.

11.5.7. Statement of reasons. In accordance with Article 17 of the same Regulation, a User affected by a restriction measure receives a clear and specific statement of reasons, indicating the measure taken and its scope, the facts justifying it, the basis relied upon (a provision of these Terms or a legal provision), the use of automated processing where applicable, and the available redress options. For a warning, a mute or a chat ban, this statement is shown in the Application, with the duration of the measure where it has one and a button to contest it. A warning remains displayed until the User confirms they have read it, which does not deprive them of the right to contest it. For the hiding or deletion of a message by moderation, the User may obtain this statement, and contest the measure, by writing to contact@scan-horizon.com.

11.5.8. Complaints. The User may contest any measure within six months of the date of the measure, from the Application ("Contest the sanction" button shown with a warning, a mute or a ban) or by writing to contact@scan-horizon.com. The complaint is reviewed by the Publisher's team, never by a player moderator. It is subject to human review and a reasoned response, sent by email to the address associated with the account. The team endeavours to respond within thirty days of its submission; this target does not shorten the six-month period. The User retains in all cases the right to bring the matter before the competent court and, if a consumer, to use the mediation provided for in Article 13.

11.5.9. Reciprocity. The User may at any time, without the Publisher being able to object, leave a clan they have joined. Structured messages they have posted to the clan feed remain visible until their account is deleted (Article 9 of the Privacy Policy). Their chat messages remain visible to clan members within the limits of Article 11.2, unless they deleted them before leaving the clan; they may also request their deletion by writing to contact@scan-horizon.com. Their participation in an ongoing challenge cannot be withdrawn before its end other than by deleting the account.

11.5.10. Reporting to authorities. In accordance with Article 18.4 of these Terms and with the law, where content published in the Application gives grounds to suspect a criminal offence threatening the life or safety of one or more persons, or is of a child sexual abuse nature, it is retained beyond the usual deletion periods and sent without delay to the competent authorities, in particular through the PHAROS platform.

11.6. Rewards, leaderboards and challenges

Rewards, benefits, bonus scans, boosts and virtual items obtained through the social features have no monetary value and are neither transferable, exchangeable, nor refundable. The thresholds, scales, periods, formats and rewards of leaderboards and challenges may be modified, suspended or discontinued at any time, in particular for technical, balancing or anti-abuse reasons.

Leaderboards are established from automatically computed data and may be subject to refresh delays, errors or unavailability. They create no vested rights.

11.7. Other users' content

The Publisher hosts, within the meaning of Regulation (EU) 2022/2065, the usernames, structured messages and chat messages published by Users. It exercises no prior control over this content other than the automated filtering described in Article 11.5.2. Each User remains responsible for the messages they post. The Publisher shall not be held liable for content published by Users, subject to its obligation to act promptly upon becoming aware of manifestly illegal content.

11.8. Minors

Social features are accessible to Users aged 13 to 17 under the conditions of Article 1.2. Holders of parental authority are invited to review the data visibility described in Article 2.10 of the Privacy Policy and may at any time request the removal of a minor's account from the public leaderboards directly from the Application ("Settings > Account > Hide from public leaderboards") or by writing to contact@scan-horizon.com. The clan chat is accessible to minors under the same conditions, with the enhanced protections provided for in Article 11.5.2 for Users aged 13 to 15. The moderator role is reserved for adult Users.

11.9. Blocking another user

The User may block another member from the menu of one of their messages in the clan chat (long press on the message).

Blocking immediately hides, for the User who blocks, the chat messages posted by the blocked user. Each hidden message can be shown on a one-off basis, at the User's choice. The blocked user is not notified of the block.

At present, blocking does not extend to the other social features (friend list, invitations, scan donations, structured messages and reactions in the clan feed). To stop a behaviour in those features, the User may remove the user concerned from their friend list, leave the clan, or report them under the conditions of Article 11.4.

Blocking can be lifted from the same menu, on a message from the blocked user still shown in the chat (after showing that message if it is hidden). Failing that, the User may ask for the block to be lifted by writing to contact@scan-horizon.com. Blocking does not constitute a report and does not by itself result in any measure against the blocked user. To report content or behaviour, the User follows the procedure in Article 11.4.

TITLE III: FINAL PROVISIONS

ARTICLE 12. MODIFICATION OF THE TERMS

12.1. The Publisher may amend these Terms and related contractual documents, in particular for legal, regulatory, technical, security, or service-evolution reasons.

12.2. Notice and new acceptance. Every new version carries a number and a date. It is brought to the User's attention when the Application is launched, and the User is asked to accept it again expressly, recorded under the conditions set out in the Preamble. A User who refuses may no longer use the Application and may request deletion of their account.

12.3. Users with an ongoing paid subscription. Where a substantial change is unfavorable to a User with an ongoing paid subscription, it is notified to them on a durable medium at least thirty (30) days before it takes effect. That User may cancel their subscription free of charge, under Article 9, within thirty (30) days of that notice. Absent cancellation within that period, the amended terms apply to them.

12.4. Changes have no effect on contracts already performed or on rights acquired before they take effect.

ARTICLE 13. COMPLAINTS AND CONSUMER MEDIATION

13.1. Prior complaint. For any difficulty, the User is invited to send a complaint to contact@scan-horizon.com. The Publisher will endeavour to respond within thirty (30) days.

13.2. Mediation. In accordance with Articles L.612-1 et seq. of the French Consumer Code, a consumer User who has not obtained satisfaction may have free recourse to the consumer mediator to which the Publisher belongs:

SMP (Société Médiation Professionnelle - Consumer Mediator)
Postal address: Alteritae, 5 rue Salvaing, 12000 Rodez, France
Website: www.mediateur-consommation-smp.fr (online referral via the "Demander une médiation" section)

Referral to the mediator requires that the User has first attempted to resolve the dispute directly with the Publisher through a written complaint, and that it occurs within one year of that complaint.

13.3. The User retains, in any event, the right to bring the matter before the competent court, under the conditions of Article 14.

ARTICLE 14. APPLICABLE LAW AND JURISDICTION

14.1. These Terms are governed by French law.

14.2. Where the User is a consumer residing in another Member State of the European Union, this choice of law shall not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.

14.3. A consumer User may bring proceedings, at their choice, before any court with territorial jurisdiction under the Code of Civil Procedure, or before the court of the place where they resided when the contract was concluded or the harmful event occurred.

ARTICLE 15. ASSIGNMENT OF THE CONTRACT

15.1. The Publisher may assign or transfer this Contract, in whole or in part, to a third party, in particular in connection with a merger, demerger, partial contribution of assets, business transfer, reorganization, or in favour of a company within its group.

15.2. Such an assignment may not result in any reduction of the rights the User holds under this Contract or in the level of protection of their personal data.

15.3. The User is informed beforehand, under the conditions of Article 12.2. They may, if they wish, cancel their subscription free of charge and delete their account before the assignment takes effect.

15.4. The User may not assign or transfer their rights and obligations under this Contract, nor their account, without the Publisher's prior written consent.

ARTICLE 16. USER'S INDEMNITY

The User indemnifies the Publisher against the financial consequences of third-party claims, actions, or judgments directly resulting from a clear breach by the User of these Terms, in particular Article 4 (intellectual property) and Article 11.3 (rules of conduct, including in the clan chat, and choice of username).

This indemnity is limited to the amounts actually paid out by the Publisher in respect of the relevant claim, excluding any lump-sum compensation.

The Publisher will inform the User of any claim within a reasonable time, allow them to present their observations, and will not settle without having consulted them.

This indemnity does not apply where the damage results, in whole or in part, from the Publisher's own breach of its obligations.

ARTICLE 17. TEST PROGRAM (BETA)

17.1. The Publisher may offer certain Users early access to test versions of the Application. Participation is voluntary, free, and revocable at any time, by the User or the Publisher, without notice or compensation.

17.2. Status of test versions. Test versions may, by nature, contain bugs, incomplete features, or data loss. They are provided with no guarantee of availability or continuity. The Publisher may modify or withdraw them at any time. This clause has no effect on the statutory conformity guarantee under Article 5 bis, which remains applicable to any paid service, including during a test phase.

17.3. Personal access. Access is strictly personal and non-transferable. Sharing an invitation link, or allowing a third party to install the Application using that invitation, constitutes a breach that may result in immediate revocation of access.

17.4. Confidentiality. The tester agrees not to publicly disclose, in particular through screenshots, recordings, or descriptions, unpublished features they become aware of, without the Publisher's prior written consent. This obligation survives the end of their participation, until the relevant features are officially released.

17.5. Feedback. Feedback submitted in this context is governed by Article 4 hereof.

ARTICLE 17 BIS. VOLUNTEER ROLES IN COMMUNITY SPACES

17 bis.1. The Publisher may entrust adult, volunteer Users with voluntary community-management or moderation roles in its community spaces outside the Application, in particular its official Discord server. This article does not apply to the clan chat moderator role, governed by Article 11.5.3.

17 bis.2. These roles create no employment contract and give rise to no remuneration or benefit in return for the activity carried out. No hours, volume of activity or availability are expected. The User performs this role freely, applying the rules common to all members of the space concerned, and may end it at any time, without notice or justification. A visible distinguishing sign may be granted; it does not depend on any volume or duration of activity.

17 bis.3. The Publisher may withdraw this role at any time, without notice. Such withdrawal is not a sanction and entails no other sanction.

17 bis.4. The practical arrangements for these roles are set out in a dedicated charter, accepted by the User before taking on the role. It supplements these Terms without derogating from them. The User remains subject to the terms of the platform hosting the space concerned.

ARTICLE 17 TER. CONTENT CREATED BY USERS ON THEIR OWN CHANNELS

17 ter.1. Content (video, image, text) created and published by a User on their own channels, including content featuring ScanHorizon, remains the property of its author.

17 ter.2. The Publisher only republishes such content on its own channels with the prior, express consent of its author, specifying the media, the duration and, where applicable, the consideration. The absence of consent in no way restricts the User's freedom to keep publishing their content.

17 ter.3. If the Publisher grants a User a benefit in connection with such content, whatever its nature (premium access, in-game item, featuring), that benefit is subject to a written agreement and the User discloses the commercial nature of the content in accordance with the regulations applicable to commercial influence.

ARTICLE 18. MISCELLANEOUS PROVISIONS

18.1. Severability. If any provision of these Terms is held void, unwritten, or unenforceable, the other provisions remain fully effective, unless the provision struck down was a determining one.

18.2. No waiver. The fact that the Publisher does not rely on a provision does not constitute a waiver of the right to rely on it later.

18.3. Entire agreement. These Terms, the Privacy Policy, and the Legal Notice constitute the entire agreement between the parties regarding the Application. For Users entrusted with a moderator role only, the charter applicable to that role (Clan Chat Moderators' Charter, or the volunteer roles charter under Article 17 bis) supplements them, without derogating from them.

18.4. Reporting to authorities. Where the Publisher becomes aware of information giving reasonable grounds to suspect that a criminal offence threatening the life or safety of one or more persons has been, is being, or is likely to be committed, it will inform the competent authorities without delay.

18.5. Language. These Terms are drafted in French. Translations into other languages are provided for convenience. In case of discrepancy, the French version prevails.

ARTICLE 19. PROVISIONS SPECIFIC TO APPLE'S APP STORE

The following provisions apply to Users who downloaded the Application from Apple's App Store.

19.1. Parties to the contract. This Contract is entered into between the User and the Publisher only. Apple is not a party to it. The Publisher, not Apple, is solely responsible for the Application and its content.

19.2. License. The license to use the Application is a personal, non-transferable license limited to use on any Apple-branded device the User owns or controls, under Apple's Media Services usage terms.

19.3. Maintenance and support. Apple has no obligation to provide any maintenance or support services for the Application. Support is provided by the Publisher, at contact@scan-horizon.com.

19.4. Warranty. In the event the Application fails to conform to any applicable warranty, the User may notify Apple, which may refund the purchase price. To the extent permitted by applicable law, Apple has no other warranty obligation. Any other claim is the Publisher's responsibility. This provision has no effect on the rights the consumer User holds under the law, in particular under Article 5 bis.

19.5. Claims. The Publisher, not Apple, is responsible for addressing any claims by the User or third parties relating to the Application, including as to product liability, compliance with legal and regulatory requirements, and consumer and data protection.

19.6. Third-party intellectual property. In the event of a third-party claim that the Application infringes its intellectual property rights, the Publisher, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

19.7. Export compliance. The User represents that they are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any U.S. Government list of prohibited or restricted parties.

19.8. Third-party terms. The User agrees to comply with applicable third-party terms when using the Application, in particular those of their mobile network operator.

19.9. Third-party beneficiaries. Apple and its subsidiaries are third-party beneficiaries of this Contract and, as such, have the right to enforce its terms against the User.
